EURO SOCCER DIRECT TERMS OF SERVICE, PARTICIPATION AGREEMENT, REFUND POLICY, AND LIABILITY WAIVER
1. Introduction
Euro Soccer Direct ("ESD," "we," "our," or "us") provides football development services, international football experiences, coaching education, player evaluation services, club partnership opportunities, educational programs, tours, showcases, networking opportunities, and related services for players, coaches, clubs, and families. By accessing our website, submitting an application, purchasing a membership, paying any fee or deposit, participating in any ESD program, or utilizing any ESD service, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service, Participation Agreement, Refund Policy, and Liability Waiver. If the participant is under the age of eighteen (18), a parent or legal guardian must review and accept these terms on the participant's behalf.
2. Eligibility and Participant Responsibilities
All participants are responsible for providing accurate, truthful, complete, and current information when applying for membership, registering for programs, or communicating with ESD. Participants agree to promptly notify ESD of any changes to their contact information, passport status, medical condition, playing experience, coaching credentials, club affiliation, or other relevant information that may affect participation. ESD reserves the right to deny, suspend, or terminate participation at its sole discretion if false, misleading, incomplete, or inaccurate information is provided. Participants are solely responsible for ensuring that they meet all eligibility requirements associated with ESD programs and activities.
3. Nature of ESD Services
Euro Soccer Direct serves as a football development and opportunity facilitation organization. ESD may provide educational resources, player evaluations, coach development opportunities, club networking opportunities, international experiences, academy visits, training programs, tours, and introductions to clubs, coaches, scouts, and organizations. ESD does not function as a licensed player agency, employment agency, scholarship agency, legal representative, immigration consultant, or contract negotiation service unless specifically stated in a separate written agreement. All services are provided on a best-effort basis and are subject to availability, scheduling, partner participation, and third-party cooperation.
4. No Guarantee of Outcomes
Participation in any ESD program does not guarantee athletic, educational, financial, professional, or recruitment-related outcomes. ESD makes no guarantees regarding academy acceptance, trial invitations, professional contracts, college scholarships, player recruitment, coaching placements, employment opportunities, sponsorships, scouting exposure, national team selection, professional advancement, financial benefits, media exposure, or any other specific result. All decisions regarding recruitment, player selection, hiring, admissions, contracts, and advancement remain solely within the discretion of third-party clubs, coaches, scouts, academies, educational institutions, governing bodies, and organizations. Any testimonials, marketing materials, promotional content, verbal discussions, success stories, or representations made by ESD should not be interpreted as guarantees of future opportunities or results.
5. Player Evaluation Services
ESD may provide player assessments, evaluations, feedback, rankings, observations, recommendations, and development guidance. All evaluations are subjective professional opinions based upon the information available at the time of assessment and are intended solely for developmental purposes. Evaluations should not be considered definitive predictions regarding future performance, recruitment potential, professional opportunities, or career advancement. Participants acknowledge that different coaches, scouts, academies, and organizations may evaluate the same player differently. ESD assumes no responsibility for decisions made by participants based upon evaluation feedback or recommendations.
6. Coach Development Programs
ESD coach development programs are designed to provide educational opportunities, mentorship, networking, observational experiences, and professional development resources for coaches. Participation in any coach development program does not guarantee employment, licensing advancement, coaching appointments, certifications, promotions, academy placements, or professional opportunities. Coaches remain solely responsible for maintaining and obtaining any licenses, certifications, registrations, permits, or qualifications required by governing bodies, clubs, or employers. ESD makes no representation regarding future employment prospects or career advancement resulting from participation in its programs.
7. Club Partnership Programs
ESD may establish partnerships, collaborations, educational initiatives, development programs, exchange opportunities, and networking relationships with football clubs and organizations. The purpose of these partnerships is to support player development, coaching education, organizational growth, and international relationship-building opportunities. Participation in the ESD Club Partnership Program does not guarantee player recruitment, player transfers, academy placements, commercial partnerships, sponsorships, financial growth, membership growth, international invitations, competitive success, or access to any specific club, academy, or organization. All partnership opportunities remain subject to availability, mutual agreement, regulatory requirements, scheduling limitations, and third-party approval.
8. International Travel Programs
ESD may organize or facilitate international football tours, training experiences, showcases, educational exchanges, academy visits, club visits, coaching development trips, and related activities. Participants acknowledge that international travel involves significant risks and uncertainties, including but not limited to transportation delays, cancellations, injuries, illnesses, weather disruptions, border restrictions, governmental actions, political instability, criminal acts, natural disasters, public health emergencies, and other circumstances beyond ESD's control. Participation in international travel programs is entirely voluntary and undertaken at the participant's own risk. Participants are solely responsible for obtaining valid passports, visas, travel documentation, vaccinations, medical clearances, insurance coverage, and any other requirements necessary for travel. Failure to obtain required travel documents shall not constitute grounds for a refund.
9. Assumption of Risk
Participants acknowledge that football and athletic activities involve inherent risks that cannot be completely eliminated regardless of the precautions taken by organizers, coaches, or facilities. These risks include, but are not limited to, physical injuries, concussions, fractures, sprains, strains, illness, permanent disability, emotional distress, transportation incidents, property damage, and death. By participating in ESD activities, participants knowingly and voluntarily assume all risks associated with football participation, training, travel, competition, evaluations, educational activities, and related events.
10. Release of Liability
To the fullest extent permitted by applicable law, participants release, waive, discharge, and hold harmless Euro Soccer Direct and its owners, directors, officers, employees, contractors, coaches, representatives, affiliates, volunteers, partners, sponsors, and associated organizations from any and all claims, liabilities, damages, losses, costs, or expenses arising from participation in ESD activities. This release includes claims related to personal injury, illness, death, property damage, financial loss, travel disruptions, athletic participation, recruitment outcomes, professional opportunities, educational opportunities, third-party actions, or any other circumstances arising directly or indirectly from participation in ESD programs.
11. Medical Authorization
Participants certify that they are physically capable of safely participating in football-related activities and understand that ESD is not responsible for determining medical fitness. Participants are encouraged to consult qualified medical professionals before participating in any program. In the event of an emergency, participants authorize ESD representatives to seek emergency medical treatment when deemed necessary. Participants remain fully responsible for all medical costs, treatment expenses, transportation expenses, insurance deductibles, and healthcare-related costs incurred as a result of participation. ESD does not provide health insurance, accident insurance, or medical coverage of any kind.
12. Photography, Video, and Media Release
Participants grant Euro Soccer Direct irrevocable permission to photograph, record, film, livestream, reproduce, publish, distribute, display, edit, and utilize their image, likeness, voice, name, biographical information, testimonials, performance footage, and participation in any ESD-related activity for promotional, educational, commercial, marketing, social media, website, print, broadcast, and informational purposes. Participants understand that such content may be used worldwide and indefinitely without further approval or compensation. By participating in ESD programs, participants waive any right to inspect or approve the final use of photographs, videos, or other media content and release ESD from any claims arising from the use of such materials.
13. Membership Fees
Membership fees provide access to ESD services, resources, communications, educational content, evaluations, networking opportunities, eligibility for programs, and administrative support. Membership fees are intended to support the operational costs of the organization, including staffing, technology, program development, administration, marketing, and infrastructure. Membership benefits may evolve over time as ESD develops new opportunities and services. ESD reserves the right to modify membership structures, benefits, pricing, and offerings at any time without prior notice. Continued use of ESD services following such changes constitutes acceptance of the revised membership structure.
14. Membership Refund Policy
All membership fees paid to Euro Soccer Direct are final and non-refundable unless otherwise required by applicable law. Upon registration, ESD immediately begins administrative, operational, planning, evaluation, communication, and support activities associated with membership. Refunds will not be provided due to scheduling conflicts, injury, relocation, personal circumstances, dissatisfaction with outcomes, perceived lack of opportunities, changes in athletic goals, coaching changes, club changes, travel restrictions affecting the participant, failure to participate, failure to utilize services, or termination resulting from violations of ESD policies. Participants acknowledge that membership fees compensate ESD for access, support, administration, and program availability rather than guaranteed results or opportunities.
15. Deposits for International Programs
Deposits paid for international tours, showcases, training camps, educational exchanges, academy visits, club visits, coaching development programs, or other travel-related experiences are used to secure reservations, accommodations, transportation arrangements, staffing commitments, facility rentals, event registrations, vendor agreements, and other planning expenses. Because ESD incurs financial obligations immediately upon registration, all deposits are strictly non-refundable unless explicitly stated otherwise in writing. Participants understand that failure to attend, inability to travel, scheduling conflicts, injuries, passport issues, visa denials, personal circumstances, family emergencies, or changes in plans do not create entitlement to a refund. ESD may, at its sole discretion, offer future program credits under limited circumstances; however, no participant shall have a contractual right to such credit.
16. Program Payment Policy
Participants agree to satisfy all payment obligations according to the deadlines established by ESD. Failure to make required payments by specified due dates may result in cancellation of participation, forfeiture of deposits, loss of reserved program space, and removal from program eligibility. ESD reserves the right to suspend services or deny participation until all outstanding balances have been paid in full. Any payment plans offered by ESD are subject to separate written terms and may be revoked if payment obligations are not met. Participants remain responsible for all amounts owed regardless of participation status unless otherwise agreed to in writing.
17. Cancellations and Force Majeure
Euro Soccer Direct shall not be responsible for delays, cancellations, interruptions, modifications, substitutions, or inability to perform services resulting from circumstances beyond its reasonable control. Such circumstances include, but are not limited to, acts of God, severe weather, natural disasters, government regulations, border closures, travel restrictions, pandemics, public health emergencies, labor disputes, transportation disruptions, facility closures, acts of terrorism, civil unrest, war, political instability, power outages, technology failures, or third-party vendor cancellations. In such situations, ESD reserves the right to modify itineraries, substitute activities, postpone programs, reschedule events, or cancel services entirely. Any refunds or credits issued under such circumstances shall be determined solely by ESD after consideration of non-recoverable costs and obligations already incurred.
18. Code of Conduct
Participants are expected to conduct themselves in a professional, respectful, responsible, and sportsmanlike manner at all times while participating in ESD programs or representing the organization. Conduct that is abusive, threatening, discriminatory, harassing, dishonest, disruptive, unsafe, illegal, or otherwise detrimental to ESD, its partners, participants, or reputation may result in immediate removal from programs and termination of membership. Participants removed for disciplinary reasons shall not be entitled to refunds, credits, compensation, or reimbursement of any kind. ESD reserves sole discretion in determining whether participant conduct violates organizational standards.
19. Intellectual Property
All content created, distributed, or made available by Euro Soccer Direct, including but not limited to logos, trademarks, branding, graphics, videos, photographs, educational materials, evaluations, documents, training methodologies, website content, marketing materials, and program resources, remains the exclusive property of ESD unless otherwise noted. Participants may not reproduce, copy, distribute, modify, publish, sell, license, or commercially exploit any ESD intellectual property without prior written authorization. Unauthorized use of ESD intellectual property may result in termination of participation and legal action where appropriate.
20. Privacy and Data Usage
Participants consent to the collection, storage, processing, transfer, and use of personal information necessary for the administration of ESD programs and services. Such information may include contact information, player profiles, coaching credentials, travel information, performance data, photographs, videos, application materials, and other relevant information provided by participants. ESD may share information with partner organizations, clubs, academies, coaches, travel providers, event organizers, and service providers when necessary to facilitate participation in programs and opportunities. While ESD takes reasonable measures to safeguard personal information, no system of data storage or transmission can be guaranteed completely secure. Participants acknowledge and accept these inherent risks.
21. Third-Party Organizations and Independent Decisions
Many opportunities facilitated through ESD involve independent clubs, academies, coaches, scouts, educational institutions, travel providers, tournament organizers, and other third-party organizations. ESD does not own, control, or manage these organizations and cannot guarantee their decisions, actions, policies, schedules, staffing, admissions criteria, recruitment processes, financial stability, or operational practices. Participants understand that all decisions regarding acceptance, recruitment, invitations, employment, admissions, evaluations, contracts, partnerships, and participation remain solely within the discretion of the relevant third party. ESD shall not be liable for decisions made by any independent organization or individual.
22. Termination of Services
ESD reserves the right to suspend, restrict, or terminate memberships, applications, registrations, partnerships, program participation, or access to services at any time and for any reason deemed appropriate by the organization. Grounds for termination may include policy violations, misconduct, safety concerns, non-payment, fraudulent activity, misrepresentation, reputational concerns, legal issues, operational requirements, or conduct deemed inconsistent with ESD values and objectives. Termination may occur with or without prior notice depending on the circumstances. No refunds, reimbursements, or compensation shall be owed following termination.
23. Governing Law
These Terms of Service, Participation Agreement, Refund Policy, and Liability Waiver shall be governed by and interpreted in accordance with the laws of the jurisdiction in which Euro Soccer Direct is organized and principally operates, without regard to conflict of law principles. Any dispute arising from participation in ESD programs or services shall be subject to the exclusive jurisdiction of the appropriate courts within that jurisdiction unless otherwise required by law.
24. Severability
If any provision of these Terms is determined by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect. The invalidity of any specific provision shall not affect the validity or enforceability of the remainder of the agreement.
25. Entire Agreement and Participant Acknowledgement
These Terms of Service, Participation Agreement, Refund Policy, and Liability Waiver constitute the entire agreement between participants and Euro Soccer Direct regarding participation in ESD programs and services. These terms supersede all prior discussions, representations, communications, marketing materials, promotional statements, and understandings, whether written or oral. By registering, applying, purchasing a membership, paying a deposit, participating in a program, submitting information, or utilizing any ESD service, participants acknowledge that they have carefully reviewed these terms, understand their contents, voluntarily accept all provisions, and agree to be legally bound by them. Participants further acknowledge that they are not relying upon any guarantee, promise, representation, or assurance regarding future outcomes, opportunities, recruitment, placement, contracts, scholarships, employment, or professional advancement.
